TERMS AND CONDITIONS OF SALE

General provisions

These Terms and Conditions apply exclusively between NETSCENT SRL, with registered office at Via Santa Lucia 123, 80132 Naples (NA), Italy, REA NA-913549, VAT No. 07836881214, hereinafter referred to as “NETSCENT”, and any person making online purchases on the website www.neos1911.com, hereinafter referred to as the “CUSTOMER”. These conditions may be subject to amendments; the date of publication on the website shall be deemed the date of entry into force.

These Terms and Conditions govern purchases made on www.neos1911.com in accordance with Part III, Title III, Chapter I of the Italian Consumer Code (Legislative Decree No. 206/2005), as subsequently amended, including Legislative Decree No. 21/2014, Legislative Decree No. 170/2021 on the legal guarantee of conformity of goods, Legislative Decree No. 26/2023 implementing EU Directive 2019/2161 (Omnibus Directive), and Legislative Decree No. 70/2003 on e-commerce.


ARTICLE 1 - Subject matter of the contract

Under these General Terms and Conditions of Sale, NETSCENT sells and the CUSTOMER purchases at a distance the tangible movable goods listed and offered for sale on www.neos1911.com. The contract is concluded exclusively via the internet, through the CUSTOMER’s access to www.neos1911.com and the completion of a purchase order in accordance with the procedure set out on the website.

Before confirming the order, the CUSTOMER agrees to read these General Terms and Conditions of Sale, and in particular the pre-contractual information provided by NETSCENT, and to accept them by ticking the relevant box.

The order confirmation email will include a link to download and save a copy of these General Terms and Conditions of Sale, as required by Article 51(1) of Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014.


ARTICLE 2 - Pre-contractual information for the consumer – Art. 49 of Legislative Decree No. 206/2005

Before concluding the purchase contract, the CUSTOMER is made aware of the characteristics of the goods as described in the individual product pages.

Before concluding the purchase contract and before validating the order with “obligation to pay”, the CUSTOMER is informed of:

• the total price of the goods including taxes, with details of shipping costs and any other charges;
• payment methods and related conditions;
• the deadline by which NETSCENT undertakes to deliver the goods;
• the conditions, terms and procedures for exercising the right of withdrawal (Art. 7), including the model withdrawal form in Annex I, Part B, of Legislative Decree No. 21/2014;
• the fact that the CUSTOMER will bear the direct cost of returning the goods in the event of withdrawal;
• the existence of the legal guarantee of conformity for the goods purchased;
• after-sales service conditions and commercial guarantees provided by NETSCENT.

ARTICLE 3 - Conclusion and effectiveness of the contract

The sales contract is deemed concluded when NETSCENT sends the CUSTOMER an order confirmation email. The email contains the CUSTOMER’s details, the order number, the price of the goods purchased, the shipping costs, the delivery address, and a link to print and save a copy of these Terms and Conditions.

The CUSTOMER agrees to verify the accuracy of the personal data contained in the confirmation email and to promptly notify NETSCENT of any corrections required.

NETSCENT endeavours to describe and present the items sold on the website as accurately as possible. However, errors, inaccuracies or minor differences between the website and the actual product may occur. Product photographs on www.neos1911.com are for illustrative purposes only and do not form part of the contract.

NETSCENT undertakes to deliver the goods within 30 days of sending the order confirmation email.


ARTICLE 4 - Product availability

Product availability refers to actual stock at the time the CUSTOMER places the order. Availability must be considered purely indicative, as due to the simultaneous presence of multiple users on the website, products may be sold to other CUSTOMERS before the order is confirmed.

Even after the order confirmation email has been sent, cases of partial or total unavailability may arise. In such cases, the order will be automatically amended by removing the unavailable product and the CUSTOMER will be immediately notified by email.

If the CUSTOMER requests cancellation of the order, NETSCENT will refund the amount paid within 14 days of becoming aware of the CUSTOMER’s decision to cancel.


ARTICLE 5 - Payment methods

Payment may be made by credit card (as indicated on the website), bank transfer, PayPal, or cash on delivery.

Bank transfer: goods will be shipped only after NETSCENT has confirmed receipt of the agreed amount in the bank account indicated in the order confirmation email (this may take 2–3 business days).

Credit card and PayPal: the CUSTOMER will be redirected to the authorised payment platform (gateway) to complete payment securely. NETSCENT does not collect any credit card data or PayPal access credentials. This information is handled directly by the gateway’s secure payment system. The charge will be made upon sending the order confirmation email.

Cash on delivery: a valid phone number reachable until delivery is required. The order will be cancelled if the CUSTOMER cannot be contacted. A surcharge of € 3.00 (VAT included) applies. Payment must be made in cash to the courier upon delivery, for a maximum amount of € 4,999.99. Cheques and other payment methods are not accepted.


ARTICLE 6 - Prices

All selling prices listed on www.neos1911.com are expressed in Euros and inclusive of VAT.

Shipping costs are not included in the purchase price; they are indicated and calculated at the end of the purchase process, before payment.

The CUSTOMER accepts that NETSCENT may modify prices at any time; however, goods will be invoiced at the prices shown on the website at the time the order is placed and confirmed in the order confirmation email.

In the event of a computer, manual, technical or other error causing a substantial and unintended change in the retail price — making it exorbitant or clearly negligible — the order will be deemed invalid and cancelled, and the amount paid by the CUSTOMER will be refunded within 14 days of cancellation.

Whenever a price reduction is communicated for a product, NETSCENT will indicate the lowest price applied in the 30 days prior to the reduction, pursuant to Article 17-bis of the Consumer Code, as introduced by Legislative Decree No. 26/2023. For products placed on the market for less than 30 days, the reference price shall be the lowest price applied during the actual period of commercialisation.


ARTICLE 7 - Right of withdrawal

Pursuant to the Consumer Code, as amended by Legislative Decree No. 21/2014, the CUSTOMER has the right to withdraw from the contract, without penalty and without stating a reason, within 14 calendar days from the date of delivery of the goods purchased.

To exercise this right, the CUSTOMER must send, within the above deadline, a communication by certified email (PEC) to [email protected] or by registered letter with acknowledgement of receipt, indicating: first and last name, address, order number, phone number, description of the product(s), and — if payment was made by bank transfer or cash on delivery — IBAN code and account holder name for the refund.

Once the communication has been sent, the CUSTOMER must return the product, at their own expense and using a courier of their choice, including the form below. The estimated return shipping cost is approximately € 30.00.

The returned goods must reach NETSCENT within 14 calendar days of the withdrawal notice.

NETSCENT will process the refund within 14 days of the withdrawal notice, provided the goods have been received or unequivocal proof of shipment has been provided. Pursuant to Article 56(3) of Legislative Decree No. 206/2005, NETSCENT may suspend the refund until receipt of the goods.

The refund will be made using the same payment method used for the original purchase.

The CUSTOMER will be held liable for any diminution in value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics. For personal hygiene and health reasons, used products cannot be returned.

Goods must be returned intact, unopened and unused, in their original packaging complete with all accessories and fiscal documentation, to:

ARTICLE 8 - Legal guarantee of conformity

All products sold are covered by the legal guarantee of conformity pursuant to Articles 128 et seq. of the Consumer Code (Legislative Decree No. 206/2005), as amended by Legislative Decree No. 170/2021, covering defects of conformity existing at the time of delivery and becoming apparent within 2 years thereof.

The seller is liable for any defect of conformity existing at the time of delivery. Pursuant to Article 132 of the Consumer Code, defects of conformity appearing within one year of delivery are presumed to have existed at the time of delivery, unless the seller proves otherwise.

The legal guarantee does not cover defects or damage resulting from accidental causes, use of the product inconsistent with its intended purpose, or normal wear and tear.

In the event of a defect of conformity, the CUSTOMER has the right, at their choice, to:

• repair of the goods;
• replacement of the goods;
• a proportionate reduction of the price;
• termination of the contract.

Repair and replacement are free of charge and must be carried out within a reasonable time and without significant inconvenience to the CUSTOMER. Price reduction or termination of the contract are available when: repair or replacement is impossible or disproportionately costly; NETSCENT has not completed repair or replacement within a reasonable time; a previous repair or replacement has caused significant inconvenience to the CUSTOMER.

The CUSTOMER is not entitled to terminate the contract if the defect of conformity is minor.

To exercise these rights, the CUSTOMER should contact NETSCENT by certified email at [email protected], by phone at +39 375.5599685, or by email at [email protected], describing the defect found. There is no time limit for reporting the defect, provided it becomes apparent within 2 years of delivery.


ARTICLE 9 - Delivery methods

Products will be delivered by express courier to the address indicated by the CUSTOMER at the time of the order, within 30 days of the order confirmation email.

For each order placed on www.neos1911.com, NETSCENT issues a sales receipt (delivery note). An invoice is not automatically issued for private consumers, as these transactions are exempt from mandatory fiscal certification pursuant to Article 22(1)(1) of Presidential Decree No. 633/1972 and Article 2 of Presidential Decree No. 696/1996. All customers receive an order summary with the same fiscal and legal value as a traditional receipt.

An invoice may be requested at the time of placing the order. After dispatch, the CUSTOMER will receive a courtesy invoice by email; the original will be available in the Italian Revenue Agency (Agenzia delle Entrate) private area via the SDI code or PEC address provided. No changes can be made to invoice data after issuance. Invoices cannot be requested after completing the order without having ticked the “Request Invoice” box.


ARTICLE 10 - Liability

NETSCENT accepts no liability for delays or failures in order fulfilment caused by force majeure or fortuitous events, including but not limited to natural disasters, pandemics, strikes, logistics disruptions, telecommunications or IT system failures, government orders, or any other unforeseeable event beyond NETSCENT’s reasonable control.

In such circumstances, NETSCENT undertakes to promptly inform the CUSTOMER and, where possible, to agree a revised delivery timeline. Should the impediment persist for more than 30 days, the CUSTOMER may cancel the contract and obtain a full refund within 14 days of the request, without any penalty.

Nothing in this article limits or excludes the CUSTOMER’s statutory rights, including the right of withdrawal under Article 7, the legal guarantee of conformity under Article 8, and any other mandatory rights under the Consumer Code.


ARTICLE 11 - Access to the website

The CUSTOMER has the right to access the website for browsing and purchasing purposes. No other use of the website or its content is permitted, in particular for commercial purposes. All elements of this website, whether audio or visual, and the related technology remain the property of NETSCENT and are protected by intellectual property rights.


ARTICLE 12 - Cookies

The website www.neos1911.com uses cookies and similar tracking technologies to ensure the correct functioning of the website, improve the CUSTOMER’s browsing experience, and — subject to express consent — to collect statistical and profiling information.

Pursuant to the Italian Data Protection Authority (Garante) Provision of 8 January 2022 and Legislative Decree No. 196/2003, as amended by Legislative Decree No. 101/2018, the CUSTOMER is informed of the use of cookies through a banner displayed on first access to the website, which allows granular consent or refusal for each category of non-technical cookies.

For complete information on the types of cookies used, their purposes, the third parties involved, and how to manage or withdraw consent at any time, the CUSTOMER is invited to consult the full Cookie Policy available on www.neos1911.com in the dedicated section.

Strictly necessary cookies required for the functioning of the website do not require the CUSTOMER’s consent and cannot be disabled via the banner, as they are essential for the use of the service.


ARTICLE 12-bis - Authenticity of reviews

Pursuant to Legislative Decree No. 26/2023, implementing EU Directive 2019/2161 (Omnibus Directive), NETSCENT guarantees that product reviews published on www.neos1911.com come exclusively from consumers who have actually purchased or used the product reviewed.

To this end, NETSCENT adopts the following verification measures: reviews may only be published by registered users who have completed a purchase of the product in question; reviews not verified as coming from actual buyers are not published.

NETSCENT does not commission or publish false or misleading reviews, nor does it permit any manipulation of product ratings. Negative reviews are not removed unless they contain unlawful, offensive, or clearly irrelevant content.


ARTICLE 13 - Severability

These General Terms and Conditions of Sale are constituted by all of the clauses composing them. If one or more provisions are considered invalid or declared so under applicable law or by a decision of a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.


ARTICLE 14 - Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by Italian law.

Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the court of the CUSTOMER’s place of residence or domicile, if located within Italian territory.

In any case, the parties may optionally resort to mediation proceedings pursuant to Legislative Decree No. 28/2010 to resolve any disputes arising from the interpretation or execution of these Terms and Conditions.


ARTICLE 15 - European Online Dispute Resolution platform

Consumers resident in Europe are informed that the European Commission has set up an online platform providing an alternative dispute resolution tool. This tool may be used by European consumers to resolve out of court any dispute relating to contracts for the online sale of goods and services. ARTICLE 16 - Personal data processing

Pursuant to EU Regulation 2016/679 (GDPR) and Legislative Decree No. 196/2003, as amended by Legislative Decree No. 101/2018, NETSCENT SRL, as Data Controller, collects and processes the CUSTOMER’s personal data exclusively for purposes related to the execution of the sales contract, order management, compliance with fiscal and legal obligations, and — subject to express consent — for marketing and commercial communications.

Data processing is carried out in accordance with the principles of lawfulness, fairness, transparency, data minimisation, and security as required by the GDPR.
